Terms of Use
Effective date: 21 September 2026.
These Terms of Use (“Terms”) apply to your use of annedesilva.com.au (“the Website”).
The Website is operated by Anne de Silva, ABN 26 512 465 914 (“I”, “me” or “my”).
Certain parts of these Terms also apply, where relevant, to content published through my professional social-media accounts and to interactions with those accounts.
By accessing or using the Website, you agree to these Terms. The separate Privacy Policy explains how personal information collected through the Website is handled.
If you do not agree with these Terms, please do not use the Website.
1. Who the Website is for
The Website, including resources made available through it, is intended for adults aged 18 years and over.
By using the Website or requesting a downloadable resource, you confirm that you are at least 18 years old and have the legal capacity to agree to these Terms.
2. Purpose of the Website
The Website provides information about me, my approach and the services, groups, workshops and other offerings that may be available from time to time. It may also include articles, reflections, practices, downloadable materials, links and other general educational or informational content.
This content is intended to inform and support reflection. It is not individual psychotherapy, psychological or medical advice, diagnosis or treatment, and should not be used as a substitute for professional care appropriate to your circumstances.
The same applies to content published through my professional social-media accounts.
3. When a therapist–client relationship begins
Using the Website, reading or using its content, requesting a downloadable resource, subscribing to emails or making an enquiry is separate from entering into a therapist–client relationship.
A therapist–client relationship begins only once we have agreed to work together, the relevant intake and informed-consent process has been completed, and your first appointment has been confirmed.
From that point, the arrangements for our work together — including privacy, confidentiality and the practical terms of therapy — are set out separately through the intake and informed-consent process.
4. Enquiries
You can contact me through the Website enquiry or contact form.
Please keep initial enquiries reasonably brief and avoid including detailed health, trauma or other sensitive personal information unless it is necessary for your enquiry.
An enquiry is simply a first point of contact. Availability changes, so the service you are enquiring about may not always be available.
5. Crisis and urgent support
I do not provide a crisis or emergency service through the Website, enquiry form, email or social media.
These channels are not monitored continuously and should not be used when a timely response is needed.
If you or someone else needs immediate or urgent help, please contact your GP, the emergency department of your nearest hospital or an appropriate crisis or emergency service.
Further crisis and urgent-support options are available here:
https://annedesilva.com.au/somatic-psychotherapy-sessions#faqs
If there is an immediate risk of harm, call Emergency Services on 000.
Comments, direct messages and other social-media interactions should not be used to seek crisis or urgent support.
6. Social-media interactions
My professional social-media accounts are public or semi-public spaces, not confidential or therapeutic communication channels. Please avoid sharing detailed personal, health, therapeutic or other sensitive information through comments, replies or direct messages.
Please do not use direct messages to enquire about, arrange or communicate with me about psychotherapy or other therapeutic services. Use the Website enquiry form or hello@annedesilva.com.au instead.
Public interactions may be visible to others, and information shared through a social-media platform is also subject to that platform’s own terms and privacy practices.
Comments or interactions may be removed, hidden or restricted if they are unlawful, abusive, discriminatory, threatening, seriously misleading, intrusive of another person’s privacy or otherwise inappropriate for the space.
7. Intellectual property
Unless otherwise stated, the Website and the original material published through it — including text, articles, written resources, downloadable materials, graphics, photographs, audio, video, practices, designs and branding — are owned by me or used with permission.
Using the Website does not transfer any intellectual-property rights to you.
Website content may be viewed and used for your own personal, non-commercial purposes, and links to publicly available pages of the Website may be shared.
Unless permitted by law or authorised by me in writing, Website content may not be copied, reproduced, republished, adapted, distributed, sold, commercially exploited or otherwise used beyond ordinary personal use.
These protections also apply to original content published through my professional social-media accounts.
8. Downloadable resources
Free downloadable resources may be available through the Website from time to time.
To receive a resource, you will be asked to provide your email address and consent to receive occasional emails about content, resources, groups, workshops, events or relevant practice updates. The sign-up form will make this clear.
Resources are for personal, non-commercial use. You may keep a copy and share the Website link so that someone else can request their own copy, but please do not forward or distribute the resource itself.
For therapists, practitioners, educators, facilitators and other professionals, personal use does not include use with clients, participants, groups, workshops, trainings, courses or in another professional or commercial context without my prior written permission.
9. Emails and privacy
If you have consented to receive occasional emails, these may include resources and content, information about groups or workshops, events and relevant practice updates.
You can unsubscribe at any time using an unsubscribe link in an email or by contacting hello@annedesilva.com.au.
The separate Privacy Policy explains how personal information collected through the Website — including enquiries, email subscriptions and requests for downloadable resources — is handled.

10. Third-party practitioners, services and resources
The Website may refer or link to practitioners, organisations, books, articles, apps, websites, services or other third-party resources.
These are included because they may be relevant or useful, but I do not control them and cannot guarantee their availability, accuracy or suitability for your circumstances.
When you follow an external link, that third party’s own terms and privacy practices apply.
The same applies to third-party material or accounts mentioned, shared or linked to through my professional social media.
11. Suitability and outcomes
People respond differently to information, reflection, therapeutic ideas, embodied practices and other resources. Something that is useful for one person may not be useful or appropriate for another.
No particular outcome can be promised from reading or using material available through the Website or its downloadable resources.
Please use your own judgment about what is appropriate for your circumstances and seek suitably qualified professional support where needed.
12. Accuracy and currency of information
Website content is prepared with reasonable care. However, information changes over time and may not always be complete, current or applicable to your particular circumstances.
Website content may be updated, amended or removed from time to time. Information, services, practitioners, resources and external links may also change or become unavailable.
13. Appropriate use of the Website
Please use the Website lawfully and in a way that respects the rights of others.
You must not use the Website:
for an unlawful or fraudulent purpose;
in a way that infringes another person’s rights;
to interfere with, disrupt, damage or gain unauthorised access to the Website or its systems;
to introduce malicious code, viruses or other harmful material;
to copy, scrape, reproduce or commercially exploit Website content contrary to these Terms;
to impersonate another person or misrepresent your identity; or
in a way that could reasonably damage the Website or the rights of another person.
Access to the Website may be restricted where there is a reasonable basis to believe these Terms have been breached, or where this is necessary to protect the Website, its users or legal rights.
14. Website availability
Reasonable steps are taken to keep the Website available and functioning, but it may sometimes be unavailable because of maintenance, technical issues, third-party services or other matters outside my control.
To the extent permitted by law, I am not responsible for loss arising solely from a temporary interruption or inability to access the Website.
15. Liability and Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any right, guarantee or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.
Subject to those rights, and to the maximum extent permitted by law, I am not liable for indirect or consequential loss arising from:
use of, or reliance on, general Website content;
use of a downloadable resource outside its intended personal-use context; or
the content, conduct, availability or outcome of a third-party practitioner, service, website or resource.
These Terms do not exclude liability where it would be unlawful to do so.
16. Changes to these Terms
These Terms may be updated from time to time if the Website, its content, technology, business practices or applicable requirements change.
The current version will always be published on the Website with its updated effective date.
If you continue to use the Website after updated Terms are published, the updated Terms will apply to that subsequent use.
17. Severability
If any part of these Terms is found to be invalid or unenforceable, that part will be read down or removed to the minimum extent necessary.
The remaining Terms will continue to apply.
18. Governing law
These Terms are governed by the laws of New South Wales, Australia.
If a dispute arises in relation to use of the Website, please contact me first so that we can try to resolve it in good faith.
If it cannot be resolved, the courts and tribunals of New South Wales will have non-exclusive jurisdiction, subject to any rights you may have under applicable law.
